Terms of Service

Terms and conditions for using Savage Chill services

1. Acceptance of Terms

By accessing and using the services provided by Savage Chill ("I," "me," or "my"), you ("you" or "client") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Savage Chill.

If you do not agree to these Terms, please do not use the services or website. Your continued use of services constitutes acceptance of any modifications to these Terms.

2. Description of Services

Savage Chill provides holistic health and fitness training services, including but not limited to:

  • Personal training sessions (in-person Palm Beach)
  • Home Resilience Lab Setup & Concierge Remote Coaching
  • Cold exposure therapy guidance
  • Breathwork instruction
  • Sleep optimization coaching
  • Nutritional guidance and meal planning
  • Mental toughness training
  • Posture assessment and corrective exercise
  • Equipment design, procurement guidance & installation oversight
  • Educational content and resources

3. Health and Safety Disclaimer

Medical Clearance

Before participating in any training program, you must:

  • Obtain medical clearance from a qualified healthcare provider
  • Disclose any medical conditions, injuries, or limitations
  • Inform me of any medications that may affect exercise participation
  • Notify me immediately of any changes to your health status

Cold Exposure Risks

Cold exposure therapy carries inherent risks, including but not limited to:

  • Hypothermia and frostbite
  • Cardiovascular stress
  • Respiratory complications
  • Shock or panic reactions
  • Slips, falls, or other physical injuries

Contraindications

Cold exposure therapy is not recommended for individuals with:

  • Heart conditions or cardiovascular disease
  • High or low blood pressure
  • Pregnancy
  • Raynaud's disease or cold sensitivity disorders
  • Eating disorders
  • Certain mental health conditions
  • Recent surgeries or injuries

Assumption of Risk

By participating in services, you acknowledge and assume all risks associated with physical training, cold exposure, and related activities. You participate voluntarily and at your own risk.

4. Liability and Indemnification

Limitation of Liability

To the maximum extent permitted by law, Savage Chill and its instructors shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of services, including but not limited to:

  • Personal injury, illness, or death
  • Property damage or loss
  • Economic losses or damages
  • Emotional distress or mental anguish

Indemnification

You agree to indemnify, defend, and hold harmless Savage Chill, its owner, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from your participation in services or violation of these Terms.

5. Payment Terms and Refund Policy

Payment

  • Payment is due at the time of service or as otherwise agreed
  • I accept cash, check, and major credit cards
  • Package payments must be paid in full unless payment plan is arranged
  • Prices are subject to change with 30 days notice

Cancellation Policy

  • 24-hour notice is required for session cancellations
  • Cancellations with less than 24 hours notice will be charged full rate
  • Emergency cancellations will be considered on a case-by-case basis
  • No-shows will be charged the full session rate

Refund Policy

  • Single session payments are non-refundable once service is provided
  • Package refunds are available within the first 2 sessions if not satisfied
  • Refunds will be processed within 7-10 business days
  • Equipment recommendation consultations are non-refundable

6. Scheduling and Attendance

  • Sessions must be scheduled in advance through approved booking methods
  • Clients are responsible for arriving on time and prepared for sessions
  • Late arrivals will not extend session times
  • Package sessions expire 6 months from purchase date unless extended
  • Make-up sessions are available within the package timeframe
  • I reserve the right to cancel sessions due to weather, emergency, or illness

7. Client Responsibilities

As a client, you agree to:

  • Follow all safety instructions and guidelines
  • Disclose any health conditions or changes
  • Arrive prepared with appropriate clothing and equipment
  • Maintain respectful and professional behavior
  • Not use services while under the influence of drugs or alcohol
  • Report any injuries or concerns immediately
  • Keep personal belongings secure (I am not responsible for lost items)
  • Maintain confidentiality regarding other clients

8. Intellectual Property

Content

All content, materials, and methodologies provided by Savage Chill are proprietary and protected by intellectual property laws. This includes:

  • Training programs and methodologies
  • Written materials and guides
  • Video and audio content
  • Website content and design
  • Trademarks and logos

Usage Rights

You may use materials solely for personal, non-commercial purposes. You may not:

  • Copy, distribute, or reproduce content
  • Use methods for commercial purposes
  • Teach or train others using proprietary methods
  • Reverse engineer or create derivative works

9. Privacy and Confidentiality

I maintain strict confidentiality regarding client information and expect the same from clients:

  • Client health and personal information is kept confidential
  • Session details and progress are not shared without consent
  • Clients must maintain confidentiality about other clients
  • Photography or recording requires explicit consent
  • Testimonials and case studies require written permission

10. Home Resilience Lab & Equipment Guidance

Equipment Design & Procurement Guidance

When providing Home Resilience Lab design, procurement guidance, and installation oversight:

  • All equipment recommendations and procurement guidance are advisory only
  • I do not warranty or guarantee equipment performance
  • Clients are responsible for all equipment purchase decisions
  • Proper installation and maintenance are client responsibilities
  • Space assessment and safety considerations are client responsibilities
  • I am not liable for injuries resulting from Home Resilience Lab use

Home Resilience Lab Setup & Installation Oversight

For Home Resilience Lab Setup & Concierge Remote Coaching:

  • All construction, installation, and setup is done at your own risk
  • Local building codes, permits, and regulations are your responsibility
  • I am not liable for equipment failure, property damage, or injuries
  • Professional installation is recommended for all electrical/plumbing work
  • Safety protocols must be followed at all times during setup and use
  • Proper flooring, ventilation, and space requirements are your responsibility

11. Termination

Either party may terminate the service relationship:

Client Termination

  • Clients may terminate services with written notice
  • Unused package sessions may be refunded per the refund policy
  • Immediate termination releases me from further obligations

My Right to Terminate

I reserve the right to terminate services for:

  • Non-payment of fees
  • Violation of terms or policies
  • Unsafe or inappropriate behavior
  • Non-disclosure of health conditions
  • Failure to follow safety instructions

12. Force Majeure

I am not liable for delays or inability to perform services due to circumstances beyond reasonable control, including but not limited to:

  • Natural disasters or severe weather
  • Government restrictions or regulations
  • Public health emergencies
  • Equipment failures or facility issues
  • Personal emergencies or illness

13. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

Dispute Resolution Process

  1. Direct Discussion: Attempt to resolve disputes through good-faith discussion
  2. Mediation: If direct discussion fails, disputes will be resolved through mediation
  3. Arbitration: If mediation is unsuccessful, disputes will be resolved through binding arbitration
  4. Jurisdiction: Any legal proceedings will be conducted in Palm Beach County, Florida

14. Modifications to Terms

I reserve the right to modify these Terms at any time. Changes will be effective when:

  • Posted on the website with updated date
  • Clients are notified via email or other communication method
  • 30 days have passed since notification of material changes

Continued use of services after changes constitutes acceptance of modified Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Invalid provisions will be modified to the minimum extent necessary to make them valid and enforceable.

17. Acknowledgment

By using services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. You confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Savage Chill regarding the use of services.
